Coverages LGLP Provides
What is Covered
LGLP provides a
reasonably broad coverage form that still permits the
establishment of a financially sound and stable liability
protection program. Generally, LGLP’s
liability program will include the following categories:
- General Liability – Liability stemming from
general services and activities, (including bodily
injury, property damage, personal injury, civil rights,
watercraft liability, among others).
- Automobile Liability.
- Directors and Officers Liability – Liability
stemming from the errors and omissions of
public officials
- Health care Providers Liability (Medical Malpractice) – Liability
stemming from the errors and omissions of
health care providers.
Governmental entities that join LGLP are required to participate
in all aspects of the program. For example, a governmental
entity will not be allowed to participate for just automobile
liability claims or just civil rights actions.
The certificate of participation (declaration page) and
rlated forms will be delivered to participating entities
upon LGLP’s receipt of the enrollment application
and payment of the contribution.
Limits
LGLP will provide each participant with a
$250,000 per person/$500,000 per occurrence limit for
claims brought under the Wyoming Governmental Claims Act.
These limits are the limits authorized by state statute.
LGLP provides $1,000,000 per occurrence limit for covered
claims brought under the federal civil rights laws and
the laws of other jurisdictions. The program retains all
governmental immunity and does not expand your liability
under the Wyoming Governmental Claims Act.
Due to concerns raised by our member entities that LGLP’s
$500,000 per occurrence limit for federal claims may not
be sufficient, LGLP procured excess insurance for federal
and out-of-state claims. The excess insurance only applies
to federal and out-of-state claims. The excess coverages
and limits are subject to change on each renewal policy
period.
LGLP coverage is on an occurrence basis. Defense costs
will be paid in addition to the limits of liability.
Deductibles
Deductible options, which apply
per occurrence, are:
- $ 250.00 per occurrence
- $ 500.00 per occurrence
- $ 1,000.00 per occurrence
- $ 2,000.00 per occurrence
- $ 2,500.00 per occurrence
- $ 5,000.00 per occurrence
Entities participating in the program have their choice
of deductibles. Ultimately, higher deductible will result
in lower annual contributions.
Prior Acts Coverage
Prior Acts coverage is
available upon request and is at the discretion of the
Executive Director. Prior acts coverage in on a two-year
(2) retro date from the date of membership. The prior
acts coverage will be in accordance with LGLP coverage
and limits of liability ($250,000/$500,000).
Currently, the LGLP Board is not charging an additional
cost for the prior acts coverage. However, the Board reserves
the right to charge an additional contribution for this
coverage if they so elect to do so.
What Is NOT Covered
LGLP will not provide
liability protection for the following:
- Claims filed against governmental entity by regulating
agencies. Example: DEQ files claim against entity
for clean up of pollutant on land owned by entity.
LGLP will not pay any fine assessed by DEQ or the costs
for cleaning up pollutant. LGLP will provide protection
for third-party claims for damages sustained by entity
polluting their land in accordance with state statutes.
- Peace Officers Professional Liability. State of
Wyoming by state statute covers peace officers.
LGLP will cover the entity and elected officials who
may be named along with the peace officer.
- Workers Compensation Claims.
- Real and personal property owned by participants
or property of others required to be insured
under contract. This is covered under entity
property insurance coverage.
- Automobile physical damage (comprehensive and collision);
medical payments; and uninsured motorist coverage.
- Any type of property coverage.
- Contractual disputes.
- Exemplary or punitive damages. Under Governmental
Claims Act a judgment for these damages is barred.
